What Is Overtime and How Is It Calculated?
Overtime is regulated by Article 41 of Labor Law No. 4857 and refers to work beyond 45 hours per week. The worker must provide written consent. Overtime pay is the regular hourly rate multiplied by 1.5. If your gross hourly rate is 100 TRY, each overtime hour earns 150 TRY gross.
The 45-Hour Weekly Working Time Rule
Under Turkish Labor Law, the standard weekly working time is up to 45 hours, distributed across working days but capped at 11 hours per day. Hours above contractual hours but below 45 are classified as "extra hours" and paid at a 1.25x rate. Each hour above 45 falls under "overtime" and is paid at 1.5x.
Calculating the 1.5x Hourly Rate
Gross hourly rate = monthly gross salary divided by (45 times 4.33), where 4.33 is the average number of weeks per month. The hourly rate is multiplied by 1.5 to find the overtime rate. For example, with a 30,000 TRY gross monthly salary: 30,000 divided by 194.85 is about 154 TRY per hour, times 1.5 equals 231 TRY gross overtime per hour.
Overtime Pay on Weekly Rest Days and Public Holidays
On national or public holidays, a worker is entitled to the daily wage they would have earned even without working, plus an additional daily wage for working that day. The same applies to the weekly rest day (typically Sunday). If the holiday or rest day work pushes weekly total above 45 hours, overtime is added on top.
Working on National and Public Holidays
Under Article 47, working on a national or public holiday earns the worker two daily wages for that day: one for the holiday itself plus one for the work performed. If this work also pushes the weekly total above 45 hours, the excess is paid at the 1.5x overtime rate.
Sunday (Weekly Rest Day) Overtime Differences
Working on the weekly rest day (typically Sunday) earns an extra daily wage similar to a public holiday. The difference is that the worker is also entitled to 24 hours of uninterrupted rest at another time. If that replacement rest is not granted, an additional day of pay is owed.
Worker Consent and Time Off in Lieu
Written consent from the worker is required for overtime. The employer cannot impose overtime without it. Even when consent is obtained at the time of contract signing, the worker may withdraw it at any time. The Labor Law also fully prohibits overtime for certain groups: workers under 18, pregnant or recently postpartum women, and workers whose health does not permit it.
Time Off in Lieu of Overtime Pay
Under Article 41/4, the worker may opt for 1 hour 30 minutes of paid time off for every overtime hour worked. This time off must be granted within 6 months of the overtime. When time off is chosen, no overtime pay is due for those hours.
